End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and COLS Learning Hub LLC ("Company," "we," or "us"), governing your use of the Cols Academy App ("Application")

Effective Date: Upon installation and use of the Application.

1. License Grant

The Company grants you a single-use, subscription-based, non-exclusive, non-transferable license to access and use the Application to attend training courses and participate in the community by posting, liking, and attending weekly live broadcasts.

2. Ownership of Intellectual Property

All rights, title, and interest in and to the Application, including any content, trademarks, logos, and intellectual property contained therein, are owned by COLS Learning Hub LLC. This Agreement does not transfer any ownership rights to you.

3. Usage Restrictions

You agree to use the Application solely for lawful purposes and in accordance with this Agreement. Prohibited activities include, but are not limited to:

- Reverse engineering, decompiling, or disassembling the Application.

- Capturing, sharing, or otherwise distributing images, recordings, or screenshots of any courses or content from within the Application.

4. Content Created by Users

Users may create and share content, such as text and images, through the Application. By posting content, you agree that you retain ownership of your content. You are responsible for ensuring that your content complies with applicable laws and does not infringe on any third-party rights.

5. Personal Information Collection

The Application may collect certain personal information from you, such as your email address, to enhance your user experience and improve our services. By using the Application, you consent to this collection in accordance with our Privacy Policy.

6. Liability and Warranty Disclaimer

- Investment Risks: Investing in financial markets involves risks, including the potential loss of principal. Users are advised to consider their financial goals and risk tolerance and to seek professional advice prior to making any investment decisions.

- Cryptocurrency Risks: Content related to cryptocurrencies is for educational purposes only. COLS Learning Hub LLC does not endorse or promote the purchase, sale, or holding of any specific cryptocurrency. Users should be aware of unique risks associated with cryptocurrency investments, such as high volatility, regulatory changes, and cybersecurity threats.

- No Warranty: The Application is provided "as-is" without any warranties, express or implied, including but not limited to any implied warranties of fitness for a particular purpose, accuracy, or reliability.

7. Support and Updates

The Company provides free support and updates to the Application. Regular updates may include new features, security patches, and bug fixes, which may be automatically installed on your device.

8. Termination of License

Your license to use the Application may be terminated by the Company at its discretion in the event of:

- Violation of any terms outlined in this Agreement.

- Non-payment of applicable fees for subscription-based services.

- Unauthorized distribution or leakage of course materials.

Access to the Application will be revoked upon termination.

9. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the United States, where the Company is licensed. Any disputes arising out of this Agreement shall be resolved in accordance with these laws.

10. Modifications to the Agreement

The Company reserves the right to modify this Agreement at any time without notifying users. Continued use of the Application following such modifications constitutes acceptance of the revised terms.

Refund Policy

Cols Academy is a data processor. We, through the Cols Academy platform, store and manage the data you have collected under your instructions. We will never use any personal data which you have uploaded to the Cols Academy system for our own purposes or without your instruction.

Legal basis for processing

As a processor, Cols Academy relies on our customers to select the correct basis under which they will be collecting and processing personal data, and to put the appropriate notices and consents in place. Before you use the Cols Academy service, you should take time to identify which legal bases may be available to you, and only collect and retain personal data to the extent necessary to carry out that basis. You should not change the basis under which you have collected personal data without very good reason, so it is important to understand the requirements of the different bases and make sure you select the right one at the start.
